Terms of Use

These Terms of Use govern the use of the website and learning platform “EuraStudy” (hereinafter referred to as the “Platform”). EuraStudy is a free, non-commercial beta project operated by a private individual (hereinafter referred to as the “Provider”); there is no company behind it. The Provider can be reached by email at eurastudy@gmail.com.

By using our Platform, you accept these Terms of Use. If you do not agree with these terms, we ask that you do not use our Platform.

EuraStudy is a digital learning platform that supports students in Austria in preparing for the Matura examination. Among other things, the Platform offers:

• Learning materials for various subjects
• Practice exercises and exam simulations
• AI-assisted learning aids and explanations
• Personalised learning recommendations
• Progress tracking and statistics

The Provider reserves the right to change, add to or remove the content and features of the Platform at any time.

3.1Registration

Registration is required in order to use certain features of our Platform. When registering, you must provide truthful, current and complete information. You may not use pseudonyms or stage names.

Registration is permitted only to natural persons who have reached the age of 14. For minor users, the consent of a parent or legal guardian is required.

3.2User Account

Upon successful registration, a user account is set up for you. You are obliged to:

• keep your access credentials (in particular your password) confidential;
• not pass them on to third parties;
• prevent the unauthorised use of your account by third parties.

Any action carried out using your access credentials is deemed to have been initiated by you. You must inform us without delay if you become aware that unauthorised third parties have obtained your access credentials.

3.3Termination of the User Account

You can deactivate your user account at any time in the settings or ask us by email at eurastudy@gmail.com to delete your account. We reserve the right to suspend or delete user accounts in the event of breaches of these Terms of Use or for other important reasons.

4.1Rights of Use

The Provider grants you a non-exclusive, non-transferable right to use the Platform, limited to the duration of use, within the contractually agreed scope. The content of the Platform may be used exclusively for personal, non-commercial purposes.

4.2User Obligations

When using our Platform, you undertake:

• not to distribute any unlawful, insulting, discriminatory or otherwise offensive content;
• not to transmit any malware, viruses or other harmful files;
• not to use the Platform in a manner that could impair its functionality;
• not to use any automated systems or bots to access the Platform;
• not to collect or process the personal data of other users without their consent;
• not to use the Platform for commercial purposes, unless expressly authorised by the Provider;
• not to take any action liable to impair the smooth operation of the Platform.

4.3User Content

Insofar as you upload or create your own content (e.g. comments, posts) in the course of using the Platform, you remain the owner of all rights to that content. However, you grant the Provider a non-exclusive, worldwide, royalty-free, transferable and sublicensable right to use, host, store, reproduce, edit, adapt, publish and distribute this content in connection with the provision of the Platform.

You warrant that you hold all necessary rights to the content you upload and that this content does not infringe the rights of third parties.

4.4YouTube Features

The Music Room includes optional features powered by YouTube API Services and the embedded YouTube player, including public search, thumbnails and video playback. By using any of these YouTube features on EuraStudy, you agree to be bound by the YouTube Terms of Service. You also acknowledge the Google Privacy Policy. If you do not accept the YouTube Terms of Service, do not use the YouTube features; EuraStudy's house music library remains available without them.

YouTube is a service provided by Google LLC. EuraStudy does not operate YouTube and is not responsible for YouTube content supplied by its respective creators or rights holders. Further details about data sent when these features are used appear in our Privacy Policy.

The Provider endeavours to ensure a high level of availability of the Platform, but cannot guarantee uninterrupted availability. In particular, technical problems, maintenance work or force majeure may lead to temporary restrictions or interruptions.

Maintenance work is carried out, as far as possible, during periods of low usage and announced in advance. There is no entitlement to constant availability of the Platform.

The Provider shall be liable without limitation for intent and gross negligence as well as under the Product Liability Act. For slight negligence, the Provider shall be liable only in the event of a breach of a material contractual obligation (cardinal obligation) and in the event of injury to life, limb or health.

The Provider shall not be liable for the accuracy, completeness and up-to-dateness of the content provided. The use of the content is at your own risk. The materials provided do not constitute legal advice and are no substitute for attending an educational institution or for advice from qualified professionals.

In all other respects, the Provider’s liability is excluded.

EuraStudy is a free, non-commercial project. Use of the Platform is entirely free of charge: there are no fees, there are no paid features, no subscriptions and no other paid services. No payment data is collected.

All content of the Platform, in particular texts, graphics, logos, icons, images, audio and video files and their compilation, is protected by copyright. The use of this content is permitted exclusively for the purposes set out in these Terms of Use.

All trademarks, logos and trade names used are protected and may not be reproduced or distributed without the prior written consent of the respective rights holder.

Official examination papers (in particular papers of the standardised school-leaving and diploma examination) are copyright-protected works of the respective publishers, in particular the Federal Ministry of Education, Science and Research (BMBWF). EuraStudy does not host any official examination files, but links exclusively to the official sources (e.g. matura.gv.at). All practice exercises on EuraStudy are our own content, oriented towards the examination standards.

The collection, processing and use of your personal data takes place in compliance with the statutory data protection provisions. You can find detailed information in our Privacy Policy.

The law of the state in which the Provider has their habitual residence applies, to the exclusion of the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the state in which you have your habitual residence as a consumer remain unaffected by this; the protection they afford is not withdrawn from you.

For legal disputes, the statutory place of jurisdiction remains decisive; as a consumer, you may in particular bring proceedings before the courts of your country of residence.

For the out-of-court resolution of consumer disputes, the European Commission provides an online dispute resolution (ODR) platform, which you can find at https://ec.europa.eu/consumers/odr.

We are neither obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration body.

The Provider reserves the right to change these Terms of Use at any time. The amended terms will be communicated to you by email and published on the Platform. The changes are deemed to be accepted if you do not object within four weeks of receiving the notice of change. In the event of an objection, the Provider reserves the right to terminate the contractual relationship at the earliest possible date.

Should individual provisions of these Terms of Use be or become wholly or partially invalid, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by a valid provision that comes closest to the economic purpose of the invalid provision. The same applies to any gaps in the provisions.
